3rd Circ. Affirms Decision to Bar DA From Prosecuting Grandmother for Sharing Child-Abuse Documents on Facebook


The U.S. Court of Appeals for the Third Circuit affirmed a lower court’s decision barring the York County District Attorney’s Office from prosecuting a grandmother for sharing on social media any child-abuse documents relating to her grandson and his death.

In a July 19 opinion, authored by Judge Stephanos Bibas, the appeals court agreed with a district court’s decision to bar the York County district attorney from prosecuting Victoria Schrader for posting the documents on Facebook. The appeals court also vacated and remanded the case to allow the lower court to enter a narrower injunction to protect Schrader’s right to publish the documents.
